This petition alleges non-compliance with an order of the Court passed on 9 February 2005 in which the following directions were carried:
"In view of the aforesaid fact, respondent no. 2 is directed to pay the provisional pension till the final decision in the criminal case and the amount of the gratuity preferably within three months from the date of certified copy of this order. It is also made clear that respondent no.2 will calculate all the amount including the G.P.F., Insurance and other retiral benefit and the total amount will be deposited in a Nationalized Bank in yearly fixed deposit and the same procedure be adopted every year till the decision of the criminal case. The amount with interest will be paid to the petitioner in case petitioner is not found guilty. If the petitioner is found guilty, the respondent can withdraw the amount deposited with interest."
Sri M.D. Singh Shekhar, learned Senior Counsel points out that subsequently the applicant has been acquitted in the criminal proceedings in terms of the judgment of the Chief Judicial Magistrate rendered on 31 January 2015. Despite the above, it is submitted that the opposite party did not release the final pensionary and other retiral dues.
Issue notice to opposite party Nos. 1 and 2 returnable within four weeks.
Post this matter before the appropriate Court on 22 February 2016. On the said date, the opposite party Nos. 1 and 2 shall be present in Court and hand over the pay order of the retiral dues and pensionary dues of the applicant or show cause.
