The petitioner has preferred the present petition under Article 227 of the Constitution of India with the prayer to set aside the order dated 19.03.2021 passed by Additional Civil Judge (Junior Division), Kanpur Dehat by which rejected the 6C application filed in the Original Suit No.475 of 2020.
After some arguments, learned counsel for the petitioner prays that the petitioner is permitted to withdraw the present petition with liberty to avail alternative remedy of appeal as provided under Order 43 Rule 1(r) of C.P.C.
Prayer is allowed.
Accordingly, this petition is dismissed as withdrawn with the liberty to the petitioner to avail the alternative remedy as provided under Order 43 Rule 1(r) of C.P.C. within ten days from today.
In case, if such an appeal is filed within stipulated period, the appellate court is directed to decide at least the stay application filed with the appeal within two weeks and entire the appeal within six weeks from the date of filing of such appeal.
