Heard learned counsel for the applicant.
Learned counsel for the applicant submits that the order dated 9.5.2019 passed by this Court in Writ C No. 16131 of 2019 was duly served upon the opposite party on 3.6.2019. But in spite of service of the order of this Court, the opposite party wilfully and deliberately, has not complied with the same.
Prima facie, a case of wilful disobedience is made out.
However, considering the facts and circumstances of the case and without issuing any notice to the opposite party at this stage, this Court has granted one more opportunity to opposite party to comply with the aforesaid order dated 9.5.2019 passed by this Court.
In view of above, applicant is directed to move an appropriate application along with certified copy of this order before the opposite party within a period of ten days, who shall decide the same with reasoned and speaking order within a period of two months from the date of production of certified copy of this order before him.
In case the order is not complied with by the opposite party within the aforesaid period, the applicant shall have liberty to approach this Court again.
With the aforesaid observation, the contempt application is disposed of.
