Prem Shankar Gupta Thru Smt. ... vs State Of U.P. Thru Principal ...

High Court Of Judicature at Allahabad|24 June, 2010

JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard Shri Vijay Saxena, learned counsel for the petitioners and the learned Advocate General as well as Shri V.K.Shahi appearing for the respondent no.2.
Learned counsel for respondent No 2 states that the allegations that Prem Shanker Gupta was detained at the Police Station concerned for several days and thereafter was released are absolutely baseless. He stated that in fact the petitioner was called at the police in connection with an inquiry in a criminal case and after interrogation, he was permitted to go back on the same day. He reiterated that the State is in possession of documents to prove that in fact the petitioner was never illegally detained at the police station.
On the previous date of hearing of the case, the State was granted time to file supplementary affidavit bringing on record within three days such documents which would prove the allegations of illegal detention to be wrong. However, no such documents have been filed by the State.
Learned counsel for opposite party No. 2 prays for and is allowed three days further time to file supplementary affidavit along with said documents.
List the case again on 7.7.2010 before the appropriate Court.
