List has been revised. Nobody is present for the petitioner. Learned Standing Counsel is present for the respondent.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 1.5.2018 passed in Writ Petition No.15597 of 2018 (Pram Shankar Dwivedi Vs. State of U.P. and Others). The operative portion of the order is reproduced hereinbelow:-
"Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with a direction to fourth respondent to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of six months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost of Rs.200/-."
It is argued by learned Standing Counsel that in compliance of the order of this court, a decision has already been taken on 8.2.2019 by the opposite party, a copy of the said order is appended as annexure 3 to the affidavit of compliance and no cause of action would further survived and prays for dismissal of the present contempt application.
Since the order of the writ court has already been complied with, therefore, no further order is required.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has liberty to challenge the same before appropriate forum.
