This application u/s 482 Cr.P.C. has been preferred seeking the quashing of impugned recovery warrant dated 30.01.2019 passed by the Principal judge, Family Court, Firozabad in Criminal Misc. Case No.68 of 2016 (Smt. Neetu and another vs. Prem Prakash) u/s 125(3) of Cr.P.C., Police Station-Shikohabad, District-Firozabad as well as entire criminal proceedings of said case pending in the court of Principal judge, Family Court, Firozabad.
Heard learned counsel for the applicant and learned A.G.A. and also perused the record.
Counsel for the applicant has not been able to point out any such illegality, much less than any abuse of court's process which may persuade this Court to interfere in the impugned order or proceedings. So far as the submission raised by the counsel that as the applicant is a poor person, the amount required to be deposited is too much and is beyond his purse, therefore, on humanitarian grounds some easy instalments may be made is concerned, this Court deems it proper to permit the applicant to move an application seeking the same prayer before the court below concerned for making some easy instalments. If such an application is moved on behalf of applicant within 15 days from today, the court below concerned shall look into the same and if it deems proper it may make some easy instalments in that regard. If the court below feels persuaded to do so, it shall have the power to make such direction on the strength of this order issued in exercise of inherent jurisdiction of this Court.
This application stands disposed of with the aforesaid observations.
