Heard Sri S.K. Upadhyay, learned counsel for the applicant and Sri I.P. Srivastava, learned A.G.A. for the State and perused the record.
The first bail application of the applicant was rejected by this Court on 21.4.2014. Thereafter the second bail application of the applicant was also rejected by this Court on 20.1.2017. This is the third bail application on behalf of the applicant.
It has been contended by learned counsel for the applicant that the applicant has been falsely implicated in the present case. As per statement of P.W.3, it is stated that the shot of the applicant did not hit the deceased. The applicant is in jail since 23.1.2013.
Learned AGA opposed the prayer for bail and submitted that the first two bail of the applicant were rejected on merit of the case. The trial is in progress.
Without expressing any opinion on the merits of the case and considering the submissions advanced, I find that no good ground is made out for enlarging the applicant on bail.
The bail application of the applicant Prem Pal, involved in case crime no.24 of 2013, S.T. No.430 of 2013, u/s 147, 148, 149, 307, 302, 504, 506 IPC, P.S. Baniyather, district Sambhal is, accordingly, rejected.
However, the trial court is further directed to expedite the trial and conclude the same preferably within the period of six months from the date of production of the certified copy of this order before the trial court, if there is no legal impediment.
The applicant is directed to produce the certified copy of this order before the trial court for it's compliance.
