Shri A.K. Upadhyay, learned counsel for the petitioner states that the petitioner will pursue appropriate remedy open to the petitioner under law in respect of Possession Notice dated 25-4-2011 (Annexure 5 to the Writ Petition) issued under Section 13 (4) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (in short "the Securitization Act"), and, therefore, the petitioner wants to withdraw the present Writ Petition, and in the circumstances, the present Writ Petition may be dismissed as withdrawn without prejudice to the rights of the petitioner to pursue appropriate remedy as may be open to the petitioner under law in respect of the proceedings being taken under the said Act.
In view of the statement made above, the Writ Petition is dismissed as withdrawn without prejudice to the rights of the petitioner to pursue appropriate remedy as may be open to the petitioner under law in respect of the proceedings being taken under the Securitization Act.
Shri Manish Trivedi, learned counsel for the respondent nos. 3 and 4 is present.
