The limited prayer in this Original Petition is for a direction to Sub Court, Thrissur to dispose of Ext.P9 petition said to have been filed by the petitioner in O.S. 180 of 2013.
2. The petitioner herein is the defendant in the suit and the suit is one for specific performance. The grievance of the petitioner seems to be that the suit document has not been produced and inspite of repeated demands that has not been produced. Therefore, the petitioner filed I.A. 1185 of 2014 seeking for stay of the suit till that document is produced by the plaintiff. The grievance of the petitioner is that that application is not being considered and the matter is being dragged on.
3. In the nature of the order that is proposed to be passed in this Original Petition, it is felt that notice to the respondent is not necessary.
O.P.(C). 2667/2014. 2 In the result, this Original Petition is allowed and Sub Court, Thrissur is directed to take up I.A. 1185 of 2014 in O.S. 180 of 2013 at the earliest and dispose of the same within two months from the date of receipt of a copy of this judgment.
