Prem Kumar vs Union Of India And Others

High Court Of Judicature at Allahabad|30 October, 2018

JUDGMENT / ORDER

Court No. - 6
Case :- WRIT - A No. - 23302 of 2018 Petitioner :- Prem Kumar Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Tejasvi Misra,Shravan Kumar Dubey Counsel for Respondent :- A.S.G.I.,Ajeet Kumar Singh
Hon'ble Yashwant Varma,J.
Heard Mr. Tejasvi Misra, learned counsel for the petitioner and Sri Chauhan, learned counsel who has appeared for the respondents 2 and 3.
The instant writ petition has been preferred seeking the issuance of a direction commanding the respondents to call the petitioner for the purposes of document verification. The petitioner appears to have applied for the post of Staff Nurse. It is the admitted position that the advertisement required the petitioner to disclose his experience in the field by producing a certificate which evidenced him having worked in a hospital with a minimum of 50 beds. It is also admitted that the petitioner due to inadvertence could not fill the column of experience in the application form. It is for this reason his candidature has not been taken into consideration by the University. Sri Chauhan, learned counsel states that the results of the selection process as per the petitioner's own showing have been declared.
Faced with this situation, learned counsel for the petitioner sought liberty for the petitioner to represent his case before the respondent Nos. 2 and 3 since in his submission the error was human and inadvertent and it would therefore cause grave injustice to the petitioner in case it is permitted to perpetuate.
Sri Chauhan, the learned counsel for the second and third respondents submitted that in case the petitioner submits a representation within 10 days from today, the competent authority of the University shall duly evaluate the same and dispose it of in accordance with law and preferably within a period of one month therefrom.
Accordingly and in light of the statement so made, which is recorded and accepted, nothing further survives on this petition, which shall in consequence stand disposed of.
It is however clarified that this Court has not evaluated the merits or otherwise of the claim of the petitioner.
Order Date :- 30.10.2018 Arun K. Singh (Yashwant Varma, J.)
