Heard learned counsel for the revisionist and learned A.G.A. for the State.
This application in revision is directed against the order dated 24.01.2011 passed by Principal Judge, Family Court, Varanasi by which he has allowed the application filed by the O.P. No. 2 for interim maintenance in Case No. 421 of 2005 (Smt. Sunita Devi Vs. Prem Kumar @ Rajesh Vishwakarma), under Section 125 Cr.P.C., Police Station Lanka, District Varanasi.
I have examined the submissions advanced by the learned counsel for the parties and perused the impugned order as well as the other materials brought on record, I do not find that the order passed by the Court below suffers from any illegality or infirmity warranting any interference by this Court.
The prayer for quashing the impugned order is refused.
However, considering the peculiar facts and circumstances of the case, it is directed that the Principal Judge, Family Court, Varanasi shall make every possible endeavour to decide the Case No. 421 of 2005, as expeditiously as possible preferably within a period of three months from the date of production of certified copy of this order.
With the aforesaid directions, this application in revision is finally disposed of.
