Heard Mr. Hritudhwaj Pratap Sahi learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 4.
The petitioner has preferred the present writ petition with the prayer to quash the order dated 25.11.2021 passed by District Inspector of Schools, Bulandshahar/respondent no.3, copy of which is appended as Annexure No.10 to the writ petition.
When the matter is taken up today, learned Standing Counsel placed the instructions along with order dated 21.12.2021 received from the office of District Inspector of Schools, Bulandshahar/respondent no.3, the same is taken on record and a copy of the same, is also provided to Mr. Hritudhwaj Pratap Sahi learned counsel for the petitioner.
It is stated in the instructions that by way of order dated 21.12.2021,the respondent no.3 has recalled its earlier order dated 25.11.2021.
In view of the above, it is argued by learned Standing Counsel for the respondents that since the order dated 25.11.2021 is recalled, therefore, no further cause of action would remain survived and prays that the present petition be dismissed as having become infructuous.
Accordingly, the present writ petition is dismissed as having become infructuous.
