Heard learned counsel for the petitioners and perused the record.
By means of this writ petition under Article 227 of the Constitution, the petitioners have prayed for following relief:-
"(I). Order or direct the respondent No.2 to expedite the application No.66 of 2019 dated 22.04.2019 filed by the petitioners under Order 9 Rule 13 of Code of Civil Procedure, 1908 for setting aside the ex parte decree dated 15.04.2017 in Civil Suit No. 802/2016 passed by the learned Court of Civil Judge (Senior Division), Ghaziabad, within stipulated period by giving time bound directions to dispose of aforesaid application."
Considering overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to conclude and decide the aforesaid application No.- 66 of 2019 dated 22nd April, 2019 filed by the petitioners under Order 9 Rule 13 of Code of Civil Procedure, 1908 for setting aside the ex parte decree dated 15th April, 2017 in Civil Suit No.- 802 of 2016, strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the parties concerned, as expeditiously as possible preferably within a period of three months from the date of production of copy of this order.
It is provided that order available on the official website of the High Court will be taken to be authentic one.
