Heard Sri S.O.V.S. Chauhan, holding brief of Sri Anand Kumar Srivastava, learned counsel for the petitioner.
The sole prayer in the present petition is for a direction to the Judge, Small Cause Court, Allahabad to decide the S.C.C. Suit No. 51 of 2015 (Prem Chandra Sinha vs. Kamlesh Kesherwani), expeditiously.
The counsel for the petitioner has referred to the order sheet of the case, a copy whereof has been filed along with the petition to submit that proceedings of the case are at advanced stage and dates are being fixed for hearing but for some reason or other the matter is being adjourned, and the delay in disposal of the suit is causing undue hardship to the petitioner.
In view of the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears in the pending proceedings and does not seek any unnecessary adjournment it is expected that the court concerned would make an endeavour to decide the aforesaid case expeditiously in accordance with law provided there is no other legal impediment.
