Heard learned Counsel for the petitioner, Sri Kunal Ravi Singh, learned counsel appearing for the respondent no.1 and Sri Ramesh Pundir, learned Standing Counsel representing State respondents.
According to the learned counsel for the petitioner the petitioner has already filed a second appeal before the State Information Commission, Lucknow on 12.06.2018 (Annexure 7 to the writ Petion) dispatched by the Registered Post (Annexure-7 to the writ petition) which is said to be still pending without any orders.
The limited relief pressed is for appropriate direction to the respondent no.1 to decide the said appeal.
On the other hand Sri Kunal Ravi Singh, leraned Counsel appearing for the State Informaton Commission submitted that the second appeal (Annexure-7) is not in the proper format and the filing of appeal is only a representation, as such the Commission would not be in a position to treat it as a appeal and decide the same.
Without going into the question whether appeal as filed is in a proper format or not, the respondent no.1 is directed to pass appropriate order on the said representation /alleged appeal, referred to above, in accordance with law, within a period of four weeks from the date of production of a certified copy of this order.
Petition is, accordingly, disposed of.
