Petitioners claim to have worked as Instructor under the None Formal Education Scheme for view years upto 1990. They claim continuance on the post relying upon an order passed by the Apex Court in Special Leave Petition No.32079 of 2015, dated 26.2.2016.
Perusal of the order of Patna High Court annexed as Annexure- 4 would go to show that considering the advance age group of the persons, the relief of rehabilitation has been refused. Protection was granted to only those who were continuing and the view is affirmed by the Apex Court. Admittedly, the petitioners out of employment for the last more than 28 years.
Considering the nature of their engagement, no relief can be granted to them at this stage. Claim of absorption prayed in the writ petition, therefore, is refused. This order, however, shall not prevent the petitioners from approaching the State Government in respect of formulation of scheme, if any.
Writ petition is accordingly dismissed.
