Heard learned counsel for the applicant, learned AGA and perused the record.
By means of the present revision, the revisionist has challenged veracity and validity of order dated 27.08.2018 passed by the learned Additional Session Judge/(F.T.C.), Court No. 3, Bulandshahr in Session Trial No. 848 of 2015 (State v. Pavan and others), whereby the application under section 319 Cr.P.C., of the revisionist has been rejected and the court has fixed 07.092018 for argument by the court concerned.
Contentions raised at the bar require detailed hearing on law and facts both.
Notice on behalf of opposite party No.1 has been accepted by learned AGA.
Issue notice to the opposite party nos. 2, 3 and 4 (Maan Singh, Smt. Santosh and Ashish respectively returnable at an early date.
Opposite party nos. 2, 3 and 4 may file counter affidavit within six weeks after the service. Learned AGA may also file counter affidavit within the same period. Rejoinder affidavit may be filed within two weeks thereafter.
List this matter immediately after expiry of the aforesaid period before the appropriate bench.
However, it is made clear that no interim order has been passed in the instant case by this Court.
