It is claimed by the petitioner that on the allegation of rape a First Information Report dated 15.2.2019 has been lodged in P.S. Badagaon, District Varanasi. It is further submitted that due to the alleged rape, the petitioner became pregnant and has approached the Chief Medical Officer, Varanasi for termination of such pregnancy by filing an application under Section 3 of the Medical Termination of Pregnancy Act, 1971 but the Chief Medical Officer has not considered the application so far, which is dated 15.4.2019.
In view of the above, the writ petition is disposed of with the direction that in case, such application is filed, the Chief Medical Officer considering the provisions of the Medical Termination of Pregnancy Act, 1971 will consider the claim of the petitioner and pass an appropriate order, as far as possible, within a period of one month from the date of production of a certified copy of this order.
