Heard Shri J.P. Gupta, learned counsel for the petitioner and learned Standing Counsel for the respondents.
The copy of the counter affidavit filed on behalf of the respondents is not on record. Duly attested copy of the counter affidavit filed by the learned Standing Counsel is taken on record.
The petitioner has filed the above noted writ petition praying for a direction to the respondents to make payment of salary and arrears of salary of the petitioner since she was duly elected Lecturer (Music Vocal) in Tilakdhdari Singh Inter College, Jaunpur. By the interim order dated 29.8.2000, the petitioner was directed to be paid her salary and continued in her work.
Learned Standing Counsel has filed counter affidavit on 15.3.2018, wherein it has been stated in paragraph No. 13 that the papers of the petitioner for consideration of her regularization in service have been forwarded to the Joint Director of Education, Varanasi vide order dated 07.10.2016.
The learned counsel for the petitioner states that till date, the Joint Director of Education has not taken any decision upon her papers for regularization in service.
This writ petition is disposed of directing the Joint Director of Education, Varanasi to decide the claim of the petitioner for her regularization in service within six weeks from the date of production of certified copy of this order before him. Till such decision, the working and payment of salary of the petitioner shall not be disturbed.
