Heard learned counsel for the petitioner and learned Standing Counsel for the State.
Present Writ Petition under Article 226 of the Constitution of India has been filed seeking direction to the Board of High School & Intermediate Education, U.P. Allahabad through its Secretary, respondent No.2 to issue admit card of Class Xth Examination and further permit the petitioner to appear in the said examination conducted by U.P. Board, Allahabad.
It is contended by learned counsel for the petitioner that the petitioner passed Class IXth and attending Class Xth and she also filled the Examination Form, but the respondents have not issued any admit card for the forthcoming examination of High School. It is also contended by learned counsel for the petitioner that the petitioner has completed 14 years and 3 months. Learned counsel for the petitioner further submits that in this regard representation dated 2.12.2019 was filed to the Principal of the College, but no decision in this regard has been taken.
Proper Authority for taking decision in this regard is the Secretary, Board of High School & Intermediate Education, U.P., Allahabad, respondent No.2. No useful purpose will be served by keeping the Writ Petition pending and calling the counter affidavit. Under the facts and circumstances of the case, petitioner is directed to submit fresh representation to the Secretary, Board of High School & Intermediate Education, U.P., Allahabad, respondent No.2 within a period of a week from today along with the certified copy of this order, thereupon, Secretary, Board of High School & Intermediate Education, U.P., Allahabad, respondent No.2 is directed to take decision on the representation of the petitioner as expeditiously as possible, preferably within a period of three weeks by a reasoned and speaking order.
