JUDGMENT / ORDER

Petition under Section 438 Cr.P.C. 2. Petitioner is the accused in Crime No.832/2014 of the Maranalloor Police Station, Thiruvananthapuram District registered for the offence punishable under Section 498A of the Indian Penal Code.
3. The allegation against the petitioner is that he had tortured and harassed his wife, who is the de-facto complainant and treated her with cruelty, after misappropriating all her gold ornaments. On 3.10.2014 at 9.30 p.m., by giving her a paper, he demanded her to write a suicide note on it as 'I am the only person responsible for my death, and no other persons are responsible for it'. As she refused to do it, he kicked her down, severely beat her and poured kerosene on her body, with a view to igniting her.

4. Heard the learned counsel for the petitioner and the learned Public Prosecutor. The contents of the C.D. Prima facie reveal the complicity of the petitioner. The wound certificate which finds a place among the records in the C.D., reveals that the petitioner had kicked on her abdomen and thereby, she has suffered bleeding after that. The allegations against the petitioner are very grave and serious. Considering the seriousness of the allegations against the petitioner, I am satisfied that the petitioner is not entitled to the discretionary relief of anticipatory bail.
In the result, this bail application is dismissed.
