It is stated that petitioner is due for promotion to the post of Inspector, but his claim had not been considered in the past, on account of adverse entry awarded to him. This adverse entry awarded in the year 2017 has been expunged under an order of the appellate authority dated 27.2.2018. It is stated that there exists no impediment now in consideration of petitioner's claim for promotion.
Learned Standing Counsel submits that the claim of petitioner shall be considered, in accordance with law.
Considering the above, this writ petition stands disposed of permitting the petitioner to approach respondent no.2, alongwith certified copy of this order. The concerned Board shall examine the claim of petitioner for promotion with reference to applicable service regulations and in accordance with law, within a period of three months from the date of presentation of certified copy of this order. In case persons junior to petitioner have been promoted, the claim of petitioner shall also be examined, as per law.
