1. Learned Counsel for the applicant pointed out that the award of the Labour Court in favour of the applicant-employee was challenged before this Court and the learned Single Judge, while disposing of Special Civil Application No.8166 of 2003, by an order dated 21.11.2005, confirmed the direction for reinstatement, but, set aside the direction for payment of back-wages.
2. Learned Counsel, further, pointed out that subsequently by an order dated 21.02.2011 passed in Miscellaneous Civil Application No.3215 of 2010, the learned Single Judge clarified that the workman would be entitled to continuation of service. The learned Counsel for the applicant has submitted that despite the order of this Court, the applicant-workman has not been granted the benefit of continuation of service.
