Mr.Dipen Desai, learned advocate for the appellants, upon instructions, states that the instant Appeal from Order is not pressed and further requests that since the dispute involved in the suit is very old one, the trial Court may be directed to expedite the hearing of the suit and dispose of the suit in accordance with law within stipulated time that may be fixed by this Court.
Request as prayed for is granted. The instant Appeal from Order stands disposed of as not pressed. The trial Court is directed to expedite the hearing of the suit and to dispose of the suit as expeditiously as possible on or before 31.12.2012.
Resultantly, the civil application for stay loses it survival value and stands disposed of.
