Heard Ms. Patel, learned Advocate for the applicant and Mr. Kodekar, learned APP for the respondent-State.
The instant application is filed in connection with Dhangadra Taluka Police Station, C.R.No. I-174/2010 seeking temporary bail for 30 days on the ground of sickness of wife of the applicant and she is required to be operated on 6.7.2012 as per the medical certificate issued by the Community Health Centre, Lakhtar, District-Surendranagar.
Having considered submissions advanced on behalf of both the sides, so also considering the medical certificate showing that the operation is scheduled on 6.7.2012, the application deserves to be allowed in part.
The application is partly allowed and the applicant-accused is ordered to be released on temporary bail for the period of two weeks from the date of his actual release on his furnishing personal bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the concerned jail authority on the condition that upon expiry of the period of temporary bail, he shall immediately surrender to the concerned jail authority.
Rule is made absolute accordingly. Direct Service is permitted. Notice is discharged.
