1. The present application is filed by the convict through his wife seeking temporary bail for a period of 45 days so as to arrange for the admission of his daughter, who has passed 5th standard with 77.33%.
2. Rule.
Mr. Pujari learned APP waives service of rule on behalf of the respondent-State.
3. The applicant has been convicted for the offences punishable under section 302 of IPC to undergo life imprisonment as awarded vide judgment and order dated 31.3.2009 in Sessions Case No. 116/2008. By now, he has undergone 3 years, 9 months and 18 days as on 28.5.2012. He has enjoyed one temporary bail and one furlough and reported in time. Nothing adverse is reported against the convict.
4. Taking into consideration the contents of the application, the same is allowed. The present applicant-convict is ordered to be released on temporary bail for a period of 30 days from the date of his release on his executing a personal bond of Rs. 5000/- (Rupees five thousand only) to the satisfaction of the Jail authorities.
5. The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
