JUDGMENT / ORDER

1. Mr. Majmudar, learned advocate for the petitioner has submitted that in view of certain subsequent developments, including the fact that a fresh circular has been issued by the Railway Authority, cause for present petition now does not survive and the petition has become infructuous. Mr. Majmudar, learned advocate for the petitioner, without entering into the merits of the petition, requested that the petition may be disposed of as having become infructuous in view of the subsequent developments. He, however, requested that the petitioner will approach the competent authority viz. respondent No.2 with request to grant appropriate number of installments to make the payment. He requested that the concerned authority may sympathetically consider the request of the petitioner.
2. On the other hand Mr. Gori, learned advocate for the respondents has submitted that if the petitioner makes request to competent authority for appropriate number of installments to make payment, the said request will be appropriately considered and necessary decision thereon will be taken by the competent authority.
3. In view of the aforesaid submission by the learned advocate for the contesting parties, particularly by learned advocate for the petitioner, the petition is disposed of as having become infructuous.
