Heard Mr.Soeb R.Bhoharia, learned advocate for the applicant. He has contended that learned Judge of the Family Court has allowed maintenance application of the respondent - wife and in between the period question of dispute resolved and again respondent - wife went to stay with the applicant - husband. After some time dispute arose and again respondent - wife left the house of husband and moved application before the learned Family Court.
Mr.Bhoharia learned advocate for the applicant seeks permission to withdraw this application with a liberty to move before the trial Court as per provisions of Section 127(2) of the Criminal Procedure Code. Permission as prayed for is granted. As and when such application is filed before the trial Court, the trial Court shall decide the same in accordance with law, uninfluenced by this order. Accordingly this application is disposed of as withdrawn.
