Learned APP has invited this court s attention to the order passed by this Court on 06.12.2012, which reads as under:
Leave to join Principal, Om Landmark Junior Science College, Mota Chiloda, Gandhinagar as one of the respondent. Issue Rule to newly joined party respondent returnable on 18.12.2012.
Learned APP, waives service of Rule on behalf of respondent State.
Direct service is permitted to newly joined party respondent No.2 The office note dated 12.12.2012 indicated that the amendment is not carried out and therefore, notice is not processed.
Learned APP submits that looking to the Party-in-Person s stand, let there be an order from this Court directing the Principal to remain present, that may serve the purpose of joining Principal, which was already ordered and the service of this order could be effected through police. It is clarified that the police is to effect only service and impress upon the Principal to remain present tomorrow before this Court. There is no order for arrest or any other coercive steps against the Principal. The police is only to serve the order upon the Principal. Accordingly, the Principal of Om Landmark Junior Science College, Mota Chiloda, Gandhinagar 382355 shall remain present before this court on 19.12.2012 at 11-00 AM.
Copy of this order be made available to learned APP for its appropriate service to Principal. S.O to 19.12.2012.
