1. In this application preferred by wife of the undertrial prisoner, a prayer is made to grant temporary bail so as to facilitate payment of school fees of Rs.24,500/- for 4th Semester of Standard 12 (Science) of her daughter Nidhi Pravinbhai Patel studying at Om Landmark Junior Science College, Mota Chiloda, Gandhingar.

Upon considering facts and circumstances, the Principal of the above college was permitted to join as respondent and who remained present on the date of hearing of the case i.e. 19.12.21012 and assured this Court to produce relevant permission by competent authority to charge such fees from a student studying in Standard 12 (Science) since the college was a self-financed.
3. Today, when the matter is called out, Principal of the above College has not remained present and in the above circumstances, it has become necessary to issue bailable warrant against the Principal, Om Landmark Junior Science College, Mota Chiloda, Gandhingar.
4. At the same time, fees for the 4th Semester of Standard 12th (Science) of the daughter of the applicant will have to be paid by the undertrial prisoner and, therefore, he is ordered to be released on temporary bail for a period of two weeks from the date of his release on furnishing personal bond of Rs.2,000/- (Rupees Two Thousand Only) to the satisfaction of the jail authority on usual terms and conditions and shall also mark his presence before the nearest police station once in a week. On completion of the temporary bail, the applicant shall surrender before the jail authorities in time.
5. However, due to non-compliance of the orders passed by this Court on 6.12.2012 and 19.12.2012, the registry shall issue notice against Principal of Om Landmark Junior Science College, Mota Chiloda, Gandhingar, to show cause why bailable warrant be not issued against him at the above address.
6. The matter is ordered to be heard on 26.12.2012.
7. Direct service is permitted and the order also to be communicated by the registry to jail authority.
