1. A grievance, which is voiced in the present applications is that despite the earlier order passed by this Court dated 26/10/2009 in Misc.Civil Application No.1401/2009 and Misc.Civil Application No.1402/2009, by which, learned Trial Court was directed to decide and dispose of Special Civil Suit No.244/2000 and Special Civil Suit No.158/2000 at the earliest but not later than 30/04/2010, the said direction is not complied with by the learned Trial Court. It is submitted that even there is no further extension sought by the concerned Judge. It is further submitted that even the learned Principal District Judge, Surat was also directed to see that the aforesaid direction was complied with by the learned Trial Court and the aforesaid two Suits be decided and disposed of within stipulated time as stated hereinabove. It is submitted that still there is no further progress in the Suits. Hence, Notice returnable on 24/02/2012.
2. In the meantime, Registry is directed to call the report/explanation from the learned Trial Court as well as learned Principal District Judge, Surat why the earlier order dated 26/10/2009 passed by this Court in Misc.Civil Application No.1401/2009 in Appeal from Order No.133/2003 and Misc.Civil Application No.1402/2009 in Appeal from Order No.134/2003, has not been complied with and why the aforesaid two Suits are not decided and disposed of within stipulated time as stated in the said order. The report shall be received by the Registry on or before 22/02/2012.
