JUDGMENT / ORDER

This application is preferred by the applicant for grant of parole of 30 days on the ground that he is suffering from problems of the spine and needs to undergo an operation for the same.
Considering the medical papers dated 01.04.2011, this Court (Coram : Hon'ble Mr. Justice J.B. Pardiwala) had passed the following order on 09.06.2011 in Special Criminal Application No.1366/2011:-
"1. This is an application preferred by the accused-convict through his mother, who has appeared as a party-in-person.
2. In this application, parole has been prayed for on the ground that the accused-convict is suffering from problem in the spinal code.
3. Recent certificate issued by the Civil Hospital suggests that there is a diffuse disc bulge at L3-L4 and L4-L5 intervertebral discs without significant nerve roots compression.
4. In this view of the matter, jail authorities are hereby directed to see that accused-convict is given proper medical treatment and periodically, he may also be taken to the Civil Hospital for treatment, if necessary."
Considering the above aspect, and since no convincing ground appears for exercise of powers, this application is rejected.
