Mr. KL Pandya, learned APP waives notice of Rule.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to perform post-death ceremony after one year from the death of his grandmother.
It appears from the jail report that the convict has recently enjoyed temporary bail from 04.09.2011 to 03.10.2011 for 30 days. Further, for the similar ceremony, on account of the death of his mother, the application was made by him being Criminal Misc. Application No.15546/11 which has not been granted on 17.11.2011.
Hence, the discretion does not deserve to be exercised. Moreover, the ground is not such where his presence can be said as indispensable since the father is already there to perform the ceremony. Therefore, the application is rejected. Rule discharged.
