(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the engagement of his sister.
Pursuant to the earlier order passed by this Court, learned APP, Mr.Pandya, based on the instructions, which he has received from Morbi City Police Station, has submitted that ground mentioned in the application is genuine.
From jail remarks, we find that whenever the applicant-convict was enlarged on temporary bail and/or on furlough leave, he has surrendered to the jail authority in time.
Considering the totality of the facts, it is ordered that the applicant-convict shall be enlarged on temporary bail for a period of 1 week from the date of his actual release on personal bond of Rs.5,000/- with one surety of like amount and with the further direction that he shall surrender to the jail authority on expiry of the period granted by this Court.
Application is allowed to the aforesaid extent. Rule made absolute.
