Mr.Pandya, learned APP waives service of rule on behalf of respondent-State.

The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to take care of treatment of his mother. No medical papers are produced.

Under the circumstances, the discretion does not deserve to be exercised at this stage and therefore, the application is not granted. Disposed of accordingly. Rule discharged.
