Mr.Kartik Pandya, learned advocate for Mr.SJ Shukla, learned advocate for the applicant, on the basis of the explanation tendered by the concerned Sessions Court dated 12.12.2011, at this stage, does not press this bail application, requesting that since by earlier order dated 30.3.2011, the concerned Sessions Court was requested to decide the Sessions Court No.54 of 2010 expeditiously, preferably within 5 months from the date of receipt of this order, yet, no substantial progress is made and, therefore, it is requested that now a fixed deadline may be given to the concerned Sessions Court to dispose of the said sessions case.
Having considered the submissions advanced by Mr.Pandya, learned advocate for the applicant, so also considering the earlier order dated 30.3.2011 passed in Criminal Misc.Application No.2515 of 2011, together with the copy of Rojkam annexed, so also more particularly considering the explanation tendered by the concerned Sessions Court dated 12.12.2011, and the estimated time suggested by the concerned Sessions Court for disposal of the said sessions case being within 5 months, the instant bail application is permitted to be withdrawn, reserving the liberty of the applicant to move for bail, in future, in case of any difficulty with the specific direction to the concerned Sessions Court to hear and decide the Sessions Case No.54 of 2010 in accordance with law within 4 months from the date of receipt of this order. The application stands disposed of accordingly. D.S permitted.
