JUDGMENT / ORDER

Court No. - 40
Case :- WRIT - C No. - 17407 of 2021 Petitioner :- Smt. Pravin And Another Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Abdul Khalik,Nuzhat Counsel for Respondent :- C.S.C.
Hon'ble Jayant Banerji,J.
Heard learned counsel for the petitioners. The learned Standing Counsel appears for the respondent nos.1 2 and 3.
This writ petition has been filed seeking a direction to the respondents not to harass the petitioners by taking any coercive method as well as as not to interfere in peacefully marriage life of the petitioners.
It is contended by the learned counsel for the petitioners that both the petitioners are adults and have married each other on their own freewill and accord as per Muslim law and in this regard a nikahnama dated 12.07.2021 has been enclosed with the writ petition at Annexure-3. It is contended that the respondent nos.2 and 3 are harassing the petitioners at the instance of respondent no.4, who is the father of the petitioner no.1.
From the record, it does not appear that any FIR has been lodged by the petitioners or against the petitioners by any person. Mere apprehension of threat cannot be made a ground to issue direction as sought for in the writ petition. Accordingly, no interference is called for in the matter.
However, it shall be open to the petitioners to approach the authorities concerned in case they are threatened by any person.
With the aforesaid observation, this writ petition is disposed of.
