The petitioner challenges the order passed by the authorities for fixation of fair value. Petitioner relies on a notification dated 13.8.2013 for fixing the fair value of Survey No.698/2 of Thalappilly village, which is owned by the petitioner’s wife. According to the petitioner, the 3rd respondent has fixed the fair value of the land comprised in Survey No.697 of Desamangalam village at Rs.63,000/- per Are under Section 28 A of the Kerala Stamp Act. 2. Therefore, in view of the fixation of fair value of the property situated in Re-Survey No. 698/2, it is submitted that this appeal has to be reconsidered in the light of the above notification.
3. In view of the above, Ext.P4 is set aside. There shall be a direction to the District Collector, Thrissur to reconsider the petitioners appeal in the light of notification dated 13.8.2014 in respect of the fair value fixed in respect of the land situated in Re-Survey No.698/2 and any other materials relied by the petitioner.
Writ petition is disposed of.
