Heard Shri Chandra Vijay holding brief of Sri Satendra Tripathi, learned counsel for applicant, Sri Sateyendra Nath Tiwari, learned A.G.A. and perused the record.
This application under Section 482 Cr.P.C has been filed for quashing the entire criminal proceeding of Case No. 137 of 2012 (State versus Praveen Singh and others) arising out of Case Crime No. 1385 of 20078, under Sections 324, 504, 323 IPC, Police Station Adampur, District J.P. Nagar (Amroha) as well as impugned charge sheet dated 24.4.2009 submitted by the investigating officer against the applicant pending in the court of Judicial Magistrate, Hasanpur, District J.P. Nagar.
After arguing the matter at length, learned counsel for the applicant confines his prayer for a direction to expeditious disposal of above referred case. Learned counsel for the applicant further contended that the above referred case is pending since 2012 and no prosecution witnesses have been examined.
In view of above, the Court below be directed to expedite the case within the stipulated period fixed by this Court.
Learned AGA has no objection to issue a direction for expeditious disposal of above case.
In view of above, it is provided that the Court below will decide the case expeditiously preferably within a period of six months from the date of production of certified copy of this order, without granting any unnecessary adjournment to any party and if adjournment is inevitable that may be subject to heavy cost and for short duration With the aforesaid observation/direction, this application is finally disposed of.
