JUDGMENT / ORDER

Violation of a job agreement lead to registration of crime against the petitioner herein in the Cheruthuruthi Police Station under Sections 406 and 420 of the Indian Penal Code. Complaint was made by the Executive Director of Jyothi Engineering College, Cheruthuruthi, that in violation of an agreement that the petitioner would serve the college for five years, he obtained leave for research, but later received some other job somewhere. A reading of the first information statement shows that the remedy available to the complainant is civil in nature. The person who made complaint is the 2nd respondent in this proceeding. Pending the proceeding he filed affidavit to the effect that he has received adequate compensation from the petitioner, and that he has no grievance or complaint now. The petitioner approached this Court when investigation was in progress. Anyway, the whole dispute now stands settled, and so investigation on the crime registered Crl.M.C No.4783 of 2014 2 against the petitioner need not continue. The affidavit filed by the 2nd respondent is accepted. I find that continuance of proceeding will not serve any purpose when the whole disputes stands resolved forever.
In the result, this Criminal Miscellaneous Case is allowed. The First Information Report in Crime No.895/2014 of the Cheruthuruthi Police Station, registered against the petitioner herein, and the further proceedings thereon against the petitioner will stand quashed under Section 482 of the Code of Criminal Procedure.
