1. Petitioner alleges that since the second respondent failed to produce the vehicle, which was seized for transporting river sand without valid permit before the jurisdictional Magistrate, he is unable to file application for release of the vehicle.
2. The petitioner is at liberty to move an application under Section 457 Cr.P.C. for release of the vehicle. If the petitioner files an application before the Magistrate concerned within a period of one week for release of the vehicle, the jurisdictional Magistrate shall dispose of the application within a period of three weeks thereafter. Writ petition is disposed of accordingly.
