Heard learned counsel for the petitioner and Sri J.S. Bundela learned Standing Counsel for the State.
This petition has been preferred for a representation of the petitioner being decided.
On being queried further it is disclosed that the petitioner remained unauthorizedly absent in the months of November and December 2016. The petitioner thereafter states that he was transferred and joined at Deoria on 02 January 2017. His prayer is for the grant of salary for the months aforementioned. However learned counsel is unable to state whether he had either applied or was granted leave for the period during which he remained absent. From the record it transpires that a show cause notice had also been issued to him for the period of unauthorized absence. Although a reply is stated to have been submitted to this notice, no disclosure has been made whether any final orders have been passed.
In view thereof, the Court finds no ground to entertain this petition which shall stand dismissed subject to the observation that it shall be open to the petitioner to assail any final order that may be passed by the respondents dealing with his claim in accordance with law.
