Heard learned counsel for the petitioner and Sri K.S. Kushwaha, learned counsel appearing for the Commission.
From the decision taken by the Commission, the Court notes that the petitioner as well as the last selected candidate in the OBC category were awarded 87 marks. Resorting to the rule of 'Tie Break' the Commission has chosen that candidate who obtained more marks in the written examination.
Undisputedly the petitioner was awarded 71 marks whereas the last selected candidate had obtained 77 marks in the written examination.
Consequently the Court finds no error in the decision of the Commission.
The writ petition is dismissed.
