Petitioner was offered compassionate appointment on 18.08.2004 on consolidated salary. His services were later regularised in the year 2010. Learned counsel for the petitioner contends that compassionate appointment could not be on fix pay and had necessarily to be a regular appointment in view of the law laid down by this Court in Ravi Karan Singh Vs. State of U.P. and others, 1999 (3) UPLBEC 2263. It is urged that the authorities are not examining petitioner’s claim and the service benefit from the period 2004 to 2010 is being arbitrarily denied to him.
Sri Suresh Kumar Singh, learned counsel appearing on behalf of respondent nos. 2 and 3 states that such claim of the petitioner would be got examined in accordance with law.
In view of the above, this petition stands disposed of with the direction upon respondent no.3 to accord consideration to petitioner’s claim for inclusion of his services rendered between 2004 to 2010 keeping in view the judgment of this Court in the case of Ravi Karan Sing (Supra) by passing a reasoned order within a period of three months.
