Sri Indra Prakash Tiwari, learned counsel for the petitioner and Sri Shyam Sundar, learned Standing Counsel for the State.
Petitioner's only grievance is that he has moved an application for grant of fire arm licence (Arms Licence Application No. 3479 of 2019) on 28.12.2019 before the District Magistrate, Etah (Respondent no. 2), but no decision has been taken on the same so far though a period of more than one year has lapsed.
Counsel for the petitioner submits that as per the provisions contained in Rule 13 of the Arms Rules, 2016, decision on the application for arms licence should have been taken by the authorities within 60 days from the date of receipt of the police report.
He prays for a direction to the District Magistrate, Etah to expedite the proceedings and take decision on the application of the petitioner for grant of fire arm licence.
After hearing arguments of counsel for the parties, this writ petition can be disposed of with a direction to the District Magistrate, Etawah to decide the petitioner's pending application, if not already decided in accordance with the provisions contained in Rule 13 of the Arms Rules, 2016 within a period of 60 days from the date of receipt of computer generated copy of the order being passed today in PDF form.
This court has not expressed any opinion on merits of the claim of the petitioner.
In above terms, the writ petition is disposed of.
