Heard learned counsel for the applicant and learned Additional Government Advocate and perused the record of the case.
By means of this application, the applicant has invoked the inherent jurisdiction of this Court under Section 482 Cr.P.C. for quashing the notice dated 9.7.2018 issued by the Additional Chief Judicial Magistrate, Court No. 3, Gorakhpur. By the said notice the applicant was called upon to appear before him through counsel on 30.7.2018 and file his reply to the same.
The aforesaid notice was issued to the applicant on a case filed by opposite party No. 2, Smt. Sarika Srivastava under Section 12 of the Domestic Violence Act.
The proper course for the applicant is to appear before the court concerned and file his reply to the notice.
The inherent jurisdiction of this Court cannot be invoked for quashing the show cause notice.
The application is misconceived. It is accordingly rejected.
