Heard learned counsel for the petitioner and learned Standing Counsel for the State. Sri Shashi Dhar Sahai has appeared on behalf of respondent no. 4.
The case of the petitioner is that he was entrusted with the work of construction of panchayat office, cattle shed and goat shed at Village Lalpur, Block Shikhar, Tehsil Chunar, District Mirzapur, after due approval and financial sanction. The petitioner claims to have carried out a major part of the work.
It is submitted that the respondents have not made payments which have become due, despite repeated representations. It is urged that the representation of the petitioners made in this regard (annexures 11 and 12) be directed to be considered.
Learned Standing Counsel has no objection to the same.
Accordingly, the writ petition is disposed of with direction to respondent no. 2 to consider and decide the representations dated 15.6.2021 and 8.7.2021 (annexures 11 and 12) expeditiously, preferably within a period of four weeks from the date of communication of the instant order.
It is clarified that we have not expressed any opinion on merits and respondent no. 2 shall examine the claim made by the petitioner independently, without being influenced by any observation made in the instant order.
