Learned counsel for the petitioner is permitted to make necessary correction in the description of respondent no.5 forthwith.
Petitioner's contention is that Sheela Yadav, respondent no. 5 has succeeded in procuring appointed based on B.P.L. certificate which in the facts of the present case ought not have been accorded, inasmuch as husband of petitioner is the man with sources as in his possession four houses are there in different villages. Petitioner submits that this is nothing but fraud.
Consequently, in the facts of the case, District Magistrate, Moradabad is directed to get inquiry conducted in the matter on the representation which has been so made by the petitioner, in accordance with law and said inquiry be concluded within two months from the date of presentation of certified copy of the order passed by this Court after providing the opportunity of hearing to Sheela Yadav, respondent no. 5.
With the above direction present writ petition is disposed of.
