1. Heard learned counsel for petitioner, learned Standing Counsel on behalf of State as well as Sri Pawan Giri, Advocate who has put in appearance on behalf of respondent Nos. 3 to 5.
2. By means of the present writ petition, the petitioner has prayed for a writ, order or direction in the nature of mandamus commanding the Tehsildar, Tehsil - Phoolpur, District - Azamgarh/Respondent No. 2 to decide the Case No. 929 of 2017, computerized Case No. T20171565703929 (Pratima Vs. Kripa Shanker & others), under Section 34 of the U.P. Revenue Act - 2006 pending before the Tehsildar, Tehsil - Phoolpur, District - Azamgarh/Respondent No. 2 within some stipulated period as fixed by this Hon'ble Court.
3. Learned Standing Counsel on the basis of instructions has submitted that Case No. 929 of 2017, computerized Case No. T20171565703929 (Pratima Vs. Kripa Shanker & others), under Section 34 of the U.P. Revenue Act - 2006 has alearedy been decided finally by the Tehsildar, Tehsil - Phoolpur, District - Azamgarh/Respondent No. 2 by means of order dated 20.10.2021. A copy of the same has already been submitted to the Court.
4. Learned counsel for petitioner does not dispute the aforesaid facts,.
4. Considering the aforesaid submissions, the prayer made in this petition does not survive and the present petitioner is consequently dismissed as infructuous.
5. The order dated 20.10.2021 passed by Tehsildar, Tehsil - Phoolpur, District - Azamgarh/Respondent No. 2 is taken on record.
