Heard learned counsel for the petitioner and Shri Manoj Kumar Yadav for the Gaon Sabha as also learned Standing Counsel for the State-respondents.
The writ petition has been filed seeking the following relief-
I) Issue writ, order or direction in the nature of mandamus directing the respondent no.1, Nayab Tehsildar Majhwar, Tehsil Sadder, District Chandauli to expedite the disposal of Case No.Rest/00706/2019 bearing Computerized Case No.T- 201914180100706 inre Manraj and others Vs. Shiv Shankar and others pending under Section 34 L.R. Act, within stipulated period.
The directions are sought for expeditious disposal on a restoration application filed by the petitioner for recall of a mutation order passed in favour of the contesting respondents. This restoration application stated to have been filed on 19.12.2018.
Perusal of the order sheet also reveals that on almost every occasion, the matter has been adjourned on account of the lawyers being on strike.
The writ petition is disposed of directing respondent no.1 to consider and dispose of the restoration application expeditiously. The petitioner shall appear in person, in case, the lawyers are on strike.
It is provided that in case the lawyers continue to be on strike and the petitioner does not appear in person, the directions above need not be complied with.
